Facts of the Case:
After genetically engineering a bacterium capable of breaking down crude oil, Ananda Chakrabarty sought to patent his creation under Title 35 U.S.C. Section 101, providing patents for people who invent or discover “any” new and useful “manufacture” or “composition of matter.” On appeal from an application rejection by a patent examiner the Patent Office Board of Appeals affirmed, stating that living things are not patentable under Section 101. When this decision was reversed by the Court of Customs and Patent Appeals, Diamond appealed and the Supreme Court granted certiorari.

Is the creation of a live, human-made organism patentable under Title 35 U.S.C. Section 101?

Yes. In a 5-to-4 decision, the Court explained that while natural laws, physical phenomena, abstract ideas, or newly discovered minerals are not patentable, a live artificially-engineered microorganism is. The creation of a bacterium that is not found anywhere in nature, constitutes a patentable “manufacture” or “composition of matter” under Section 101. Moreover, the bacterium’s man-made ability to break down crude oil makes it very useful.

The five Justices responsible for launching this corporate assault on the natural world were:

The BEAST now considers the frontiers of the future to be related to biotechnology. Taking out patents on living things is now legal. Patented GMO seeds by Monsanto are also legal and are a direct result of the Chakrabarty case.

“Without any discussion, corporations now can own the blueprints of life”. The ownership of DNA issue is very significant because in 2007 a law was passed granting the government the power to collect, catalog and store the DNA of every child born in the U.S. There is now a great race by biotech companies to patent each gene they discover – human and other.

The public is not aware of this very significant debate, which is going on without their input: Does life have intrinsic value, or is it just another commodity for the BEAST to produce, package and sell? This explains why ‘natural solutions’ to healthcare and energy are not funded . . . in fact are suppressed. Only solutions that corporations can patent are advanced and their Frankenscientists are now busy creating freaks:  Clones, Animal-Human Hybrids and human-machine creatures known as Cyborgs. These psychopaths consider these faux creatures to represent the ‘evolution of mankind’ into its Post-Human state.
